Petitioner, who is in custody, seeks bail in connection with Chandramandi P.S. Case No. 05 of 2015 registered for the offences punishable under Sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act.
Informant is the Police Officer, who in his written complaint has stated that he received information that 1 1⁄2 -2 Km north-west of village Sapaha illegal arms and other explosive substance which is being used in Naxal activity, was kept hide by the petitioner. On such information, he alongwith other police personnel reached there and searched, where one A.K. 56 rifle, 17 live cartridges, battery, Spoon, Red pen and other articles has been recovered.
Patna High Court Cr.Misc. No.50943 of 2018(7) dt.11-01-2019 2/2 Considering the nature of allegation made against petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, the trial court is directed to expedite and conclude the trial within one year from date of receipt/production of a copy of order passed by this Court. Petitioner is granted liberty to renew his prayer for bail if trial court is not concluded within one year.
