1. Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 498(A) of the Indian Penal Code and Sections 3 and 4 of the D. P. Act.
3. The learned counsel for the petitioner submits that the matter was referred for mediation and the mediation has succeeded. It is next submitted that the petitioner and the
Patna High Court CR. MISC. No.47039 of 2023(4) dt.29-02-2024 2/2 opposite party no.2 are staying together and are leading a peaceful conjugal life.
4. The said submission of the learned counsel for the petitioner is not dispute by the learned counsel appearing on behalf of the opposite party no.2 that mediation has succeeded and the petitioner and the opposite party no.2 are staying together.
5. Considering the submissions made by the learned counsel for the parties, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with C.R. No.435 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
6. The application stands allowed.
