The petitioner seeks regular bail in connection with Patrakar Nagar P.S.Case No.194 of 2017 registered for offences punishable under Sections 419, 420, 406, 468, 274, 275, 276 and 120B of the Indian Penal Code and Sections 27(a), 27(c ), 27(b) (ii), 28, 28(A), 18(A), 18(B), 17(A), 17(B), 18(a)(ii), 18(c), 36AC of the Drugs and Cosmetic (Amendment) Act, 2008. Allegation against the petitioner is that he was illegally manufacturing the spurious drugs in his house and the police raided the place and seized several spurious drugs from his house.

Submission of the learned counsel for the petitioner is that this house belongs to one Navin Kumar The petitioner has been falsely implicated in this case and he has no concern with the

Patna High Court Cr.Misc. No.45796 of 2017 (3) dt.11-10-2017 2/2 seized articles. The petitioner has remained in custody for about six months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Kumari Vijaya Sub Judge-X-cum-A.C.J.M., Patna in connection with ---Patrakar Nagar P.S.Case No.194 of 2017.

With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.

With the aforesaid observation, this application is allowed.
