2. The petitioner seeks regular bail in connection with Kishanganj P.S. Case No. 214 of 2024 registered for the offence under Sections 376D and 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is accused of committing gang rape.
4. Learned senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He further submits that the victim has not supported the prosecution case in her deposition. The petitioner is in custody since 05.06.2024.
5. Learned A.P.P. appearing for the State has

6. Considering the facts and circumstances of the as well as the fact that the victim has turned hostile and not supported the prosecution case and the period of custody, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge 1st-cumSpecial Judge, Kishanganj/concerned Court below in connection with Kishanganj P.S.
