The petitioner seeks pre-arrest bail in connection with Pranpur (Rosna) P.S. Case No. 62 of 2015 registered under Sections 341, 323, 324, 325, 326, 307 and 379 read with 34 of the Indian Penal Code.
It is contended that though the allegations against the petitioner is that he inflicted with dabia blow on the head of the informant, the injury report, as contained in Annexure-3, would make it evident that the informant Rupesh Singh had sustained simple and superficial injury, which was caused by hard and blunt substance. It is further contended that under no circumstance the offences punishable under Sections 326 and 307 of the Indian
Patna High Court Cr.Misc. No.43363 of 2015 (2) dt.13-10-2015 2/2 Penal Code would be made out in the present case. Learned counsel for the State has opposed the prayer for bail.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner Manoj Singh @ Manoj Kumar Singh, who is reported to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Pranpur (Rosna) P.S. Case No. 62 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Pradeep/- U T
