JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The limited prayer of the petitioner, in the present writ petition, is to direct the Circle Officer, Brahampur, DistrictBuxar, to dispose off the encroachment proceedings initiated, vide Encroachment Case No.04 of 2021-22.

The learned counsel for the respondent-State submits

Patna High Court CWJC No.11020 of 2022(2) dt.01-05-2023 2/2 that in case the aforesaid encroachment case is still pending, the same shall be taken to its logical conclusion, within a fixed time frame.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the Circle Officer, Brahampur, Buxar to dispose off the aforesaid encroachment case by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in case the same has not already been passed, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
