The petitioner apprehends his arrest in connection with Jamui Mahila P.S. Case No.28 of 2016 registered under Sections 323, 341 and 498(A)/34 of the Indian Penal Code. The accusation is of torturing the informant-opposite party no.2 by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and ousting the informantopposite party no.2 from her matrimonial house after snatching her child.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the informant-

Patna High Court Cr.Misc. No.50595 of 2016 (5) dt.19-06-2017 2/2 opposite party no.2 and is ready to keep the informant-opposite party no.2 with full honour and dignity but the informant-opposite party no.2 herself is not ready to live with the petitioner. It is further submitted that the matter was referred to the Patna High Court Mediation Centre, Patna, for settlement of the dispute in between the petitioner and the informant-opposite party no.2 but in spite of notice issued to the informant-opposite party no.2, she did not turn up before the Patna High Court Mediation Centre, Patna, for settlement of the dispute.

The report dated 24.04.2017, as submitted by the Mediator, has been kept at flag 'M'.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jamui, in connection with Mahila P.S. Case No.28 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
