JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 30-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Barari P.S. Case No. 144 of 2021, registered for the offences punishable under Sections 7 E.C. Act.

At the very outset, learned counsel for the petitioner has submitted that the petitioner is a lady of clean antecedent. She is a PDS dealer and one person was found with 30 litres of kerosene oil and he disclosed that that kerosene oil was taken by him from the PDS shop of the present petitioner.

Learned counsel for the petitioner has submitted that not a single customer/beneficiary has made complaint against the

Patna High Court CR. MISC. No.52169 of 2021(3) dt.30-08-2022 2/2 petitioner. He has also submitted that some entries were mismatched and reason thereof was that those entries were of the same day and after the end of the day the entire entries used to be maintained in the register.

Considering the above-mentioned facts and circumstances and also considering that petitioner is a lady of clean antecedent, let the petitioner, in the event of her arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Barari P.S. Case No. 144 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
