The petitioner apprehends his arrest in Sasaram Mufassil P.S. Case No. 427/2016, registered for the offences punishable under Sections 307, 353 and other sections of the Indian Penal Code, Section 27 of the Arms Act and Section 47(A) of the Excise Act.

The S.H.O. of Sasaram Muffasil alleged that Kanhaiya Singh and his accomplishes made fire in which one constable got fire-arm injury. On raid Kanhaiya Singh, his wife and other fled away. The police raided different places and apprehended Munna Kumar the nephew of Kanhaiya Singh.

Learned counsel for the petitioner submits that petitioner

Patna High Court Cr.Misc. No.30215 of 2016 (2) dt.14-09-2016 2/2 is the wife of Kanhaiya Singh. There is no allegation against her. The petitioner has been made accused in the case, as she happens to be the wife of Kanhaiya Singh.

Considering the facts aforesaid and the fact that petitioner is a lady and there is no allegation against the petitioner, Kanhaiya Singh and his accomplishes are alleged to have fired causing fire-arm injury to the constable, the petitioner abovenamed, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Sasaram (Rohtas), in connection with Sasaram Mufassil P.S. Case No. 427/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
