JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353, 385, 504, 506/34 of the Indian Penal Code.

The prosecution case is that the petitioner along with 57 unknown persons came and assaulted the informant and demanded Rs. 3 lacs as extortion and in case of non payment life threat was given to informant for which written complaint was filed on 15.03.2016. On 16.03.2016 at 9. 30 AM the petitioner along with 5-7 unknown persons arrived at Government Middle School, Rajopatti, where the informant is Incharge headmaster, and started damaging papers kept in the school. The petitioner also gave threatening to informant to kill him and assaulted him. It is

Patna High Court Cr.Misc. No.28282 of 2016 (2) dt.14-07-2016 2/2 further alleged that petitioner was demanding extortion from the informant.

It is submitted by the learned counsel for the petitioner that with false accusation the FIR has been lodged. The petitioner side also filed complaint case against the informant on 19.03.2016. Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Sitamarhi P.S. case No.151 of 2016 pending before learned Chief Judicial Magistrate, Sitamarhi.

This application is disposed of with the aforesaid observation/ direction.
