JUSTICE SUDHIR SINGH ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Sessions Trial No.48 of 2017 arising out of Sathi P.S. case No.46 of 2016 registered under Sections 304B, 120B/34 of the Indian Penal Code, pending in the court of Sessions Judge, Bettiah, West Champaran.

Allegation is that the accused persons including the petitioner committed murder of the daughter of the informant due to non-fulfilment of demand of dowry.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that the postmortem report supported the allegations made in the F.I.R.

Patna High Court Cr.Misc. No.50777 of 2018(3) dt.11-10-2018 2/2 A report was called for from the Trial Court regarding the stage of the trial. It has been reported that only the doctor is to be examined in the present case and the trial is expected to be concluded within a period of three months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. The District Magistrate, Bettiah, West Champaran and the Superintendent of Police, Bettiah, West Champaran are also directed to take necessary steps to produce the remaining witness/witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period. Let this order be communicated to the District Magistrate, Bettiah, West Champaran and the Superintendent of Police, Bettiah, West Champaran.
