2. The petitioners have prayed for bail in connection with Kishanpur P.S. Case No. 117 registered for the offence punishable under Sections 341, 342, 324, 325, 307, 504, 506, 302 read with Section 34 of the Indian Penal Code.
3. The case of the prosecution is that the informant was sleeping at his house and at that time, Sanjay Kumar Ram and Manoj Kumar Ram awoke him and took him out. As he came out, 10 persons including the petitioners were there. The

No.40168 of 2025(3) dt.04-09-2025 2/3 informant was assaulted by these persons and one of the accused person has tied his neck with a Gamcha due to which, the informant fell down and they started assaulting him badly, due to which he got unconscious. After that he was locked in a room and on a scheduled place, he was electrocuted with a view to commit murder. Despite that the informant was alive and has given his written application before the police. On this written application, Jagdev Yadav and Yogendra Kumar have put their signature. During the course of treatment, the informant died.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. Learned counsel for the petitioners have submitted that in this case, one of the accused persons namely, Sanjay Kumar Ram has faced the trial and in his trial, the witnesses of the FIR namely, Jagdev Yadav and Yogendra Kumar have given their evidence and they have stated that the deceased died due to electrocution. It has also been submitted that the deposition of these witnesses in sessions Trial No. 99 of 2022 goes to show that a false case was filed. He further submits that a statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Petitioners are languishing in judicial

5. The application for bail is opposed by learned APP for the State and submits that the evidence which was given against Sanjay Kumar Ram is not relevant for these petitioners and from perusal of the case diary, it is clear that the witnesses of the FIR have supported the case of the prosecution.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioners on bail at this stage, as such, the bail of the petitioners stands rejected.
7. However, the petitioners will be at liberty to renew their prayer for bail after six months if the trial is not concluded. (Ashok Kumar Pandey, J) Sudhanshu/- U T
