The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. During investigation, co-accused Md. Saddam disclosed to the police that he along with Guddu and Bablu had committed the crime alleged. The spy of the police reported that the petitioner was seen nearby the place of occurrence and that is why the petitioner has been implicated in this case. Petitioner has not been put on T.I. parade. Investigation of the case is already complete.

Hence, there is no substantial material against the petitioner to refuse the prayer for bail. Accordingly, the

Patna High Court CR. MISC. No.38379 of 2020(2) dt.19-02-2021 2/2 petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Hajipur P.S. Case No. 394 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
