2. The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 91/2025 registered for the offence s punishable under Sections 338/336(3)/340(1)/318(4) of the B.N.S.S.

3. As per the First Information Report lodged by the In-charge Medical Officer, P.H.C., Garkha, Saran, the petitioner was running Pratima Prakhash Lakwa Emergency Hospital, in Rampur, Garkha, Saran without having any medical degree recognized by the government and without having the hospital registration.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of complaint made by one Sunny Kumar before the District

No.48842 of 2025(2) dt.11-08-2025 2/3 Magistrate, Saran and from perusal of the enquiry report (Annexure-3), it would be evident that Dr. Vidya Sagar and one Dr. Shailesh Chandra were found in the aforesaid hospital with valid degree. No medical shop was found running in the nursing home. He further submits that Sunny Kumar lodged the case against the petitioner which was enquired by the police and police found the allegations made against the petitioner fully false and submitted final form in this case. The petitioner has taken vocational training of Electro Homeopathy, Acupressure and Acu-puncture and is running training school and he is also trained by a vocational institute. The petitioner is employee of the said hospital and share ownership in the property of the hospital.

5. Learned A.P.P. for the State has opposed the bail petition.

6. I have heard the parties and perused the materials on record.

7. From perusal of the enquiry report dated 04.02.2025 submitted before the District Magistrate, Saran, it appears that the hospital in question was being run by the petitioner having the board of Dr. Ajit Kumar Singh, B.E.M.S. (petitioner) and Dr. Shivani Kumari, B.A.M.S.

8. The petitioner claims himself to be a trainer in Electro Homeopathy, Acupressure and Acu-puncture. The hospital was also not having any registration for running it. The petitioner has B.E.M.S. degree which is not a valid degree to run a hospital. If nursing home is run by unqualified doctors (quacks), it could have serious repercussions on public health. It could undermine trust in the health care system, accordingly, I am not not inclined to grant the petitioner privilege of anticipatory bail.
