The petitioners seek bail in a case registered for offences under Sections 30 (a) and 35 of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 120 cartoons having 48 bottles containing 180 ml each of foreign liquor were allegedly recovered from the canal situated at about 500 meters eastern side of the Government School at Kharpura Village and the petitioners' name have been disclosed in the confessional statement of co-accused, Chandan Kumar and also on his
Patna High Court Cr.Misc. No.39294 of 2017(2) dt.19-08-2017 2/2 confession, the petitioners have been implicated in another case, i.e., Sasaram (Model) P.S. Case No. 112 of 2017 for offences under Section 420 IPC and Sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016. It is further contended that the petitioners are in custody since 15.05.2017. Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 124 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
