JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 20.3.2018 seeks bail in Dulhin Bazar PS Case No. 11 of 2018 registered under Sections 457, 354 of the IPC and Section 8 of the Pocso Act. The allegation in brief is that the petitioner repeatedly tried to outrage modesty of the girl even by making trace pass in the house of the prosecutrix.

Learned Counsel for the petitioner submits that only attempt of outraging modesty is alleged against the petitioner, he has been in custody in this case for last three months and charge-sheet has also been submitted in this case.

Having considered the said facts and circumstances, the petitioner, namely, Avinash Kumar @ Gunjan Kumar is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I -cum- Special Judge, Patna in connection Dulhin Bazar PS Case No. 11 of 2018, with the condition that the petitioner shall not indulge in similar offence otherwise his bail bond shall be liable to be cancelled.
