JUSTICE SANJAY PRIYA ORAL ORDER 02-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in N.D.P.S. Case No. 22 of 2017 arising out of Kalyanpur P.S. Case No. 27 of 2017 instituted for the offence under Section 414 of the Indian Penal Code, Sections 20, 22 and 23 of N.D.P.S. Act.

It is alleged in the written report that 49 kg. Ganja kept in 07 packets has been recovered from cabin of the truck. Petitioner was driver-cum-owner of the aforesaid truck. Petitioner is said to be in custody since 5.3.2017. Report was called for about present stage of the case which has been received. The court below has mentioned in the report that charge has been framed and case is pending for evidence.

Prayer for bail of the petitioner stands rejected. The Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of copy of this order.

Petitioner is given liberty to renew the prayer for bail if the trial is not concluded within aforesaid period. (Sanjay Priya, J) S.Ali/- U T
