Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Atri P.S. Case No. 360 of 2018 for the offence registered under Sections 420, 467, 468, 471, 196, 197, 198, 199 and 120(B) of the Indian Penal Code.
Allegation against the petitioner is that he was member of Appointment Committee for the Panchayat Teacher and in collusion with other members of the committee, he appointed Sarita Kumari as a teacher on the basis of false BETET Mark-sheet and Admit Card.
Learned counsel for the petitioner submits that the

No.1583 of 2021(3) dt.01-11-2021 2/2 petitioner has falsely been implicated in the present case with allegation that being Member Secretary of the Selection committee, he appointed Sarita Kumari but as a mater of fact, at the time of her appointment, the petitioner was not secretary of the Selection committee. It is further submitted that similarly situated co-accused person, namely, Surendra Prasad, has been granted bail by a co-ordinate Bench of this Court passed in Cr. Misc. No. 31228 of 2019. It is further submitted that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIII, Gaya in connection with Atri P.S. Case No. 360 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
