The petitioner seeks bail in S.Tr.No.643 of 2017arising out of Motipur P.S.Case No.37 of 2017 registered for the offences under Section 302/201 of the I.P.C.

Earlier prayer for bail of the petitioner was rejected vide order dated 12.04.2018 passed in Cr.Misc.No.21307 of 2018 by the then coordinate Bench of this Court.

Submission on behalf of the learned counsel for the petitioner is that informant is the father of the deceased Sheela Devi who is not an eye witness. There is no direct evidence and only on the basis of confessional statement of the petitioner he has been falsely implicated in this case. He is in custody since 15.02.2017.

Patna High Court Cr.Misc. No.52838 of 2018 (3) dt.05-10-2018 2/2 Heard the learned A.P.P. and the informant who opposed the prayer for bail of the petitioner.

Having heard both sides and in view of the fact that earlier prayer for bail of the petitioner has been rejected on merit, I am not inclined to grant bail to the petitioner. However, let the trial be expedited.

This application is dismissed.
