The petitioner is in judicial custody since 18.12.2020 in connection with Kankarbagh P.S. Case No. 989/20 cum Spl. Case No. 26 of 2020 registered under Sections 354 and 506 of the Indian Penal Code and Section 8/12 of POCSO Act presently pending before the Court of learned Spl. Judge cum ADJ-VI, Patna.

The allegation, as per the First Information Report is that when the informant's daughter was going towards her coaching institute, the petitioner herein tried to tease her. Thereafter, his daughter came back home and narrated the incident. Next day when the informant tried to talk to the petitioner herein, he came out with sword and started

Patna High Court CR. MISC. No.51546 of 2021(3) dt.31-03-2022 2/2 brandishing the same stating that he will kill every one. The informant thereafter went to the police station and lodged the First Information Report which resulted into the arrest of the petitioner herein.

Considering the nature of allegation as also the fact that the petitioner is in judicial custody since 18.12.2020, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned ADJ-VI cum Spl. Judge, POCSO Act, Patna in connection with Kankarbagh P.S. Case No. 989 of 2020 cum Spl. Case No. 26 of 2021 with the following conditions :- (I) one of the bailor should be the family member of the petitioner, who shall furnish documents in support of his relation with the petitioner.

(ii) he shall visit the concerned police station every fortnight for three months to make his presence. With the aforesaid observations, the bail application is allowed.
