2. The petitioner has filed the present application for modification of the order dt. 13.4.2023 passed in Cr. Appeal (SJ) 239 of 2023 whereby the petitioner was granted bail with a condition to pay Rs. 3000/- per month as maintenance to the informant, subject to submitting her bank account details to the petitioner.
4. It is submitted by learned counsel for the petitioner that petitioner denies the performance of marriage with the informant and the charge-sheet has also not been submitted under Section 498(A) of the Indian Penal Code nor cognizance has been
Patna High Court CR. MISC. No.62512 of 2023(6) dt.20-03-2024 2/2 taken under the aforesaid section against the petitioner. The petitioner is a poor person and he has no reliable source of income to pay Rs. 3000/- per month as maintenance to the informant.
5. In that view of the matter, the order dated dt. 13.4.2023 passed in Cr. Appeal (SJ) 239 of 2023 is modified to the extent that the petitioner is directed to pay the maintenance amount for three months to the informant as directed by this Court.
6. The learned Court below is directed to accept the bail bonds of the petitioner on showing receipt of payment of three months as directed by this Court.
7. Accordingly, the petition stands allowed.
