The petitioner has renewed his prayer for bail in connection with a case registered under sections 467, 468, 471 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is submitted by learned counsel for the petitioner that in a case registered for recovery of illicit liquor, the earlier application for bail moved by this petitioner was rejected vide order dated 2.3.2021 (Annexure-1) passed in Cr. Misc. no.40977 of 2020 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. The petitioner is in custody since 23.8.2020 i.e. for more than 1 year.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 2.3.2021 together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Dinara P.S. Case no.246 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd-cum-Special Judge, Excise, Rohtas, Sasaram.
