JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Dhibra P.S. Case No. 6 of 2017, registered for offences punishable under Sections 366A/34 of Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant and establishing physical relationship with her.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and statement of girl under Section 164 Cr.P.C. has been recorded shows that there was love affair between the parties and she had gone with the petitioner out of her own sweet will but later on due to pressure of the parents such statement has been made. Further he has been in custody since 22.06.2017
Patna High Court Cr.Misc. No.47049 of 2017 (3) dt.08-11-1201 2/2 Learned counsel for the State opposed the prayer for bail and submitted that the girl in this case is minor and her consent is of no importance.
Having heard both sides, considering the fact and circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below that once charge is framed in this case, he shall release the petitioner on bail to his own satisfaction.
