2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 302/201 of the IPC.
3. As per the prosecution case, these petitioners and other accused persons killed sister of the informant.
4. It is submitted on behalf of the petitioners that deceased was first wife of co-accused Hari Nandan Sardar and during investigation, no direct or indirect evidence has come against the petitioners to show their complicity in the occurrence. Husband of deceased has already been acquitted in trial vide Sessions Trial No. 257/2021. Petitioner no.1 is 2nd wife of co-accused Hari Nandan Sardar and petitioner
Patna High Court CR. MISC. No.39481 of 2025(2) dt.26-06-2025 2/2 no.2 is her brother. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Madhepura in Kumarkhnd Police Station Case No. 216 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
