This application for grant of anticipatory bail arises out of Kopa P.S. Case No. 56 of 2016, disclosing offences under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise Act.
It is alleged that from possession of the co-accused Birendra Rai, five liters of illicit country made liquor was recovered. The said co-accused Birendra Rai, had disclosed the name of the petitioner that he has purchased the said country made liquor from the petitioner.
Considering the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail.
This application is, accordingly, rejected.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
