JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2016 Heard learned Counsel for the petitioner, the informant and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Darihat Police Station Case No. 15 of 2016, disclosing offences under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code.

The petitioner, at the relevant point of time, was posted as Junior Engineer.

It is the allegation of the informant that without any application filed by him or any request made on his behalf, his electricity connection was transferred in the name of co-accused Shankar Singh.

Patna High Court Cr.Misc. No.36948 of 2016 (2) dt.19-09-2016 2/3 On perusal of the First Information Report, it appears that primarily there is dispute between the informant, Narendra Prasad, and co-accused Shankar Singh, over running of a rice mill. Lodging of the First Information Report is a result of the said dispute. In any event, considering the nature of allegation, it appears that learned counsel for the petitioner is right in his submitted that there is no chance of tampering with the evidence or interfering in course of investigation.

Considering the submission, as above, this application is allowed.

Let the petitioner, Ranjit Prasad @ Ranjeet Kumar @ Rjnit Prasad, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Dhirendra Kumar, learned Judicial Magistrate, 1st Class, Dehri-on-sone, Rohtas, in connection with Darihat Police Station Case No. 15 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as
