Today son of the informant has filed an affidavit stating therein that Kotwali P.S. Case No.605 of 2012, G.R. No.6025 of 2012, Trial No 2358 of 2013 for offences under Sections 323 and 504 of the Indian Penal Code leading to the order of cognizance dated 26.2.2013 has been settled outside the court with the intervention of well-wishers and family members. Basically it is a family dispute between Uncle and nephew though it arises from a police case.
As already stated they have settled the dispute and their grievances have been settled in view of nature of allegation and relationship this Court feels that no useful purpose will be served for
Patna High Court Cr.Misc. No.36545 of 2013 (13) dt.21-01-2015 keeping the matter pending.
In this view of the matter, the order of cognizance dated 26.2.2013 relating to Kotwali P.S. Case No.605 of 2012, G.R. No.6025 of 2012, Trial No 2358 of 2013 for offences under sections 323 and 504 of the Indian Penal Code is hereby quashed. This order has been passed on the basis of concession given by both the parties. Accordingly this application is allowed.
