The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 62 of 2016 registered under Sections 366A/34 of the Indian Penal Code.
The informant alleged that his daughter was kidnapped by accused persons namely Arbind Kumar, Vikram Kumar, Dharmendra Kumar, Nitish Kumar and Jeeva Kumar. Learned counsel for the petitioner submits that the informant is not an eye witness to the occurrence. The victim girl had love affair with Arbind Kumar and she fled away with Arbind Kumar. The victim girl gave her statement under Section 164 Cr. P.C. and also disclosed the name of the petitioner but the victim is a major girl.
Patna High Court Cr.Misc. No.31698 of 2016 (4) dt.09-11-2016 On the other hand, learned counsel for the informant submits that the victim is a minor girl, aged about 16 years. Prayer for anticipatory bail of the similarly situated co-accused Vikram Kumar and Arbind Kumar has already been rejected. Taking into consideration the fact that there is allegation against the petitioner that he along with other accused persons kidnapped the victim girl, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
