ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 365/506 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier after investigation, the petitioner was not sent up for trial, but subsequently, on the basis of the protest petition, after a lapse of eight years, the petitioner has now been roped in and cognizance has been taken against him as well as two others. It is further submitted that other similarly situated persons Kamal Yadav and Umesh @ Ragi Yadav, who have now been sent up for trial, have been extended the privilege of anticipatory bail vide order

Patna High Court Cr.Misc. No.27587 of 2016 (2) dt.20-08-2016 P2/2 dated 13.07.2016 passed in Cr. Misc. No. 26423 of 2016. The petitioner also thus, deserves to be extended the same privilege. In view of the facts and circumstances of the case and also the nature of allegations, the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya, in connection with Complaint Case No. 1206/04, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
