The Petitioner seeks bail in Warsaliganj P.S. Case No.14 of 2017 instituted for the offence under Section(s) 420, 467, 468, 171, 120-B Indian Penal Code, Section 10 of Examination Control Act and Section 66 of the IT Act.
It has been submitted that the name of this petitioner has been disclosed by those persons from whose possession it is alleged that different items like Laptop, Mobile and different documents have been recovered. There is no recovery from the possession of this petitioner.
It has been submitted that other co-accused have been granted bail by this Court by order dated 30.06.2017 in Cr. Misc. No.24210 of 2017 and its analogous cases. Other co-
Patna High Court Cr.Misc. No.27117 of 2017 (3) dt.26-07-2017 2/3 accused with similar allegation have also been granted bail by a co-ordinate Bench of this Court by order dated 14.07.2017 passed in Cr. Misc. No.25639 of 2017 and order dated 10.07.2017 passed in Cr. Misc. No.26158 of 2017.
As per written report, the informant got information that Gauri Shankar Sahrma had taken the house of one Satya Narayan Sharma on rent for the purpose of providing help to examinees appearing at Bihar Staff Selection Commission Examination through illegal means such as Mobile, Blue Tooth, Whatsapp etc. and they are realizing huge amount from the candidates, who have to appear on 05.02.2017 in the examination. Name of the petitioner appears at serial no.42 in the written report.
There is no recovery of any incriminating articles from the possession of the petitioner.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, Nawada, in connection with Warsaliganj P.S.
