JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 09-07-2021 As prayed for, through video conferencing, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 23.12.2020, within four weeks of starting of the Court proceeding in physical mode properly. Heard the parties through video conferencing. The petitioners seek pre-arrest bail in connection with K. Hat (Maranga) P.S. Case No. 481 o 2020, registered under Sections 273 of the Indian Penal Code and 30(a) Bihar Prohibition and Excise Act, 2016.

On receiving secret information about selling of the illicit liquor at the house of Yogenra Uraon at Hat Maranga, the informant, along with other police personnel, reached at the house of Yogendra Uraon. On search house of Yogendra Uraon, several bottles of Indian made foreign liquor in volume of 432 liters were recovered. On query, Yogendra Uraon disclosed that before four days both the petitioners (Neeraj Yadav and Sanjay Yadav @ Sanjeev Kumar Yadav), sons of

Patna High Court CR. MISC. No.38901 of 2020(2) dt.09-07-2021 2/2 late Mahendra Yadav @ Mahendra Prasad Yadav, had concealed the seized liquor for sale.

Submission is that both the petitioners have no criminal antecedent and they have falsely been implicated in this case due to dirty village politics as the names of the petitioners have come in the confessional statement of Yogendra Uraon, who was found at his house from where 432 liters Indian made foreign liquor recovered. Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with K. Hat (Maranga) P.S. Case No. 481 o 2020 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Purnea, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
