The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.
Seventy litres of illicit Mahua liquor were recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner
Patna High Court Cr.Misc. No.45333 of 2015 (2) dt.03-11-2015 2/2 surrenders before the learned court below within a period of six weeks from today in connection with Warisaliganj P.S. Case No. 220 of 2015 pending in the court of learned Chief Judicial Magistrate, Nawada.
With the aforesaid observation, this application is disposed of.
