JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 14-10-2015 The present application has been filed for modification of order dated 05.03.2014 passed in Cr. Misc. No. 52012 of 2013 to the extent for relaxing the regular appearance to the present ailment of the petitioner as he claims that he was admitted in IGIMS.
The petitioner was granted anticipatory bail in Complaint Case vide C.R. No. 211 of 2011 pending in the court of learned Sub-divisional Judicial Magistrate, Dalsingsarai, Samastipur on the condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation or even on single default in payment or on any willful violation of
Patna High Court Cr.Misc. No.44105 of 2015 (2) dt.14-10-2015 2/2 the undertaking, the liberty granted shall be deemed to be cancelled.
It is submitted by learned counsel for the petitioner that the petitioner is making payment as directed by the court regularly and till date has regularly appear before the learned court below. Statements to that effect have been made in paragraph nos. 5 and 6 of the modification application. Considering the above facts, the order dated 05.03.2014 passed in Cr. Misc. No. 52012 of 2013 is modified to the extent that the learned court below will be at liberty to cancel the bail bonds of the petitioner, if the petitioner defaults for four consecutive occasions during trial.
Accordingly, this modification application is disposed of.
