JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-02-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Begusarai Town P.S. Case No. 264 of 2020 for the offence under Sections 188, 269, 270, 271 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act.

From the statements made in para 3 of the bail petition, it appears that fourteen (14) cases are pending against the petitioner.

As per the prosecution case, one loaded 9 mm pistol was seized from the car belonging to this petitioner. Learned counsel for the petitioner submits that the petitioner is a petty contractor connected with the Railways construction work. The petitioner is in custody since 26.05.2020.

Considering the fact that arms was recovered from the

No.38827 of 2020(2) dt.10-02-2021 2/2 car of the petitioner, although the car is of the petitioner and he is in custody since 26.05.2020, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 264 of 2020 with the condition that the petitioner shall deposit Rs.50,000/- (Fifty thousand) cash in the court below and the same shall abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.50,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited.
