Petitioner is apprehending his arrest in connection with Harsidhi P.S. Case No.711 of 2023, registered for the offence punishable u/s 302, 201, 34 of the IPC.

As per the prosecution case, the F.I.R. named accused persons including the petitioner are alleged to have committed murder of the son of the informant by chopping his body and thereafter threw the dead body in river.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior motive. No such occurrence in the manner as alleged has ever taken place. Petitioner is the father-in-law of the deceased and

Patna High Court CR. MISC. No.45874 of 2024(2) dt.24-07-2024 2/2 there is no specific overt act against him. There is no eye witness to the alleged occurrence. Petitioner has been made accused merely on the basis of suspicion. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seek for regular bail, the learned Court below shall pass the order on the same day in accordance with law.
