The petitioner apprehends his arrest in Parsauni P.S. Case No. 31/2016, registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506 and 34 of the Indian Penal Code and Section 3 of Prevention of Witch Practices Act. The informant alleged that when she was tying her shegoat with Khoonta, Chulhai Bhagat (petitioner) asked her not to tie her she-goat and began to abuse. On protest the petitioner and others came there and assaulted the informant and her family member. Petitioner is alleged to have assaulted the informant with iron rod on her hand.
It is submitted that altercation took place due to tying of she-goat. On account of assault made by the petitioner there was
Patna High Court Cr.Misc. No.30132 of 2016 (2) dt.09-09-2016 2/2 swelling in hand of the informant which is opined to be simple in nature.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Parsauni P.S. Case No. 31/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
