JUSTICE PURNENDU SINGH ORAL ORDER 08-07-2026 At the outset, learned counsel appearing on behalf of the petitioners seeks to withdraw the prayer for bail on behalf of petitioner no.1 Ram Niwas @ Ram Nivas Das, submitting that the petitioner no.1 has been arrested during the pendency of the bail application.
2. In view of the above, the prayer for bail on behalf of petitioner no.1 Ram Niwas @ Ram Nivas Das stands dismissed as withdrawn.
3. Heard learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.43816 of 2026(2) dt.08-07-2026 2/3 petitioners and learned APP for the State.
4. The petitioner nos. 2 to 5 seek pre-arrest bail in connection with Kinjer P.S. Case No. 40 of 2026 registered for the offence punishable under Sections 191(2), 191(3), 190, 115(2), 117(2), 109(1), 351(2), 351(3) and 352 of the BNS.
5. As per the allegation made in the F.I.R., all the accused persons including the petitioners are said to have assaulted the informant and her family members causing them injury.
6. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have falsely been implicated in the case. The allegation alleged against them is not specific rather general and omnibus. The specific allegation of assault is against other co-accused.
7. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
8. Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the F.I.R. and the fact that two injuries are simple in nature and one is grievous, but in absence of any specific allegation attributable to any of the petitioners, the petitioner nos. 2, 3, 4 and 5, are directed to be released on pre-arrest bail, in the event

No.43816 of 2026(2) dt.08-07-2026 3/3 of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Arwal in connection with Kinjer P.S. Case No. 40 of 2026, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.
9. The District Court is directed to verify the criminal antecedent of the petitioner nos. 2 to 5 and if it is found that the petitioner nos. 2 to 5 are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
10. The bail application stands disposed of.
