The petitioners are in custody in connection with Khajauli P.S. Case No. 46 of 2017 for the offences under Sections 341, 323, 324, 307, 427, 480, 448, 454/34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act. It appears from perusal of the record that there is case and counter case on account of the land dispute and both sides have sustained injury in the scuffle.
Counsel for the petitioners submits that other side who have been made accused in the counter case, have been granted bail by the court below.
Patna High Court Cr.Misc. No.36088 of 2017 (2) dt.10-08-2017 2/2 In the supplementary affidavit injury report has been placed on record which indicates that the nature of the injury is simple.
Considering the fact that there is case and counter case and both sides have sustained injuries and also that injury sustained by the informant side in the instant case appears to be simple in nature, let the petitioners above named, be enlarge on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.III, Madhubani or the successor Court in connection with Khajauli P.S. Case No. 46 of 2017 (G. R. No. 803 of 2017) subject to the condition that the petitioners will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
