====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 28.03.2019 in a case for the offence registered under Sections 366(A) and 365/34 of the IPC.

The prosecution story, in brief, is that on 15.03.2019 the informant's wife alongwith daughter and nephew had gone for treatment at Muzaffarpur and on that very day, they were going to his cousin in the night and in the way, co-accused Rohit Kumar met to them and offered them for any help, if needed. It is further alleged that in the night at about 2.00 A.M. co-accused

Patna High Court CR. MISC. No.39316 of 2019(2) dt.27-06-2019 2/3 Rohit Kumar called his daughter upon which, she went to open the door, but did not return, thereafter few minutes his wife and other family members went for search but none was there. It is further alleged that when he alongwith other co-villager went to petitioner-father of co-accused Rahul Kumar, and asked to return his daughter, he abused and threatened. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. From the F.I.R. itself, it is evident that the victim girl has left with the son of this petitioner and for the said reason, he has been made accused. There was love affairs between the son of this petitioner and the victim. The petitioner had no concern with the alleged occurrence. No allegation of abduction has been alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/ Complaint Case. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
