2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Saharsa Sadar P.S. Case No. 995 of 2024 instituted for the offence under Sections 137(2), 62, 125, 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The case of the prosecution is that on 20.09.2024 at about 7-8 PM, the daughter of the informant, namely, Sandhya Kumari, was walking outside the house. Meanwhile Pankaj Ram arrived there on his bike and Shankar Ram @ Shiv Shankar Ram (petitioner no.1) was already there. It is alleged that both the accused persons attempted possible force to board the daughter

Patna High Court CR. MISC. No.40176 of 2025(2) dt.25-07-2025 2/3 of the informant on bike. The informant raise alarm, then crowd gathered and both the accused persons ran away. It is further alleged that Pankaj Ram, Shiv Shankar Ram and others started pelting stones and due to which one Nikhil Kumar also got badly injured. He was injured by the brick thrown by Panjak.

4. Learned counsel for the petitioners has submitted that the main thrust of allegation is against Pankaj Ram. Pankaj Ram is not the petitioner here. It has also been submitted that the daughter of the informant was having affair with son of the petitioner, namely, Jai Kishor Ram and that she had fled with him for which earlier a case was filed. It has also been submitted that the petitioners and the informant are next door neighbours. There is a counterblast of this case, moreover, Pankaj is not the petitioner.

5. Learned APP appearing for the State has opposed the prayer of bail of the petitioners.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Saharsa Sadar P.S. Case No. 995 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court CR. MISC. No.40176 of 2025(2) dt.25-07-2025 3/3 (Rupees ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, subject to the conditions as laid down under section 482(2) of the BNSS.

7. Accordingly, the present bail application stands allowed.
