ANJANA PRAKASH ORAL JUDGMENT Date: 07-07-2015 No one appears on behalf of the Opposite Party No.2 on repeated calls.
The Petitioners, who are the married sisters-in-law (Nanad) of the Opposite Party No.2, seek quashing of the order of cognizance dated 13.7.2007 passed by the Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in Complaint case No.296 of 2007. The case of the Complainant is that she was married to the brother of the Petitioners in the year 2000 whereafter she went to her matrimonial home. Initially she was happy but later on the in-laws started torturing and taunting her for inadequate dowry. She was also assaulted severely and ousted from the matrimonial home.
Patna High Court Cr.Misc. No.52960 of 2008 dt.07-07-2015 2/2 It has been submitted on behalf of the Petitioners that they are married sisters-in-law of the Complainant and are living in their own in-laws house with their respective husbands and children since a long time. They had no business with the affairs of the Complainant and her husband. Moreover the allegations are vague in nature, which does not inspire confidence.
Having considered the nature of allegations, relationship and the period of marriage, the application is allowed so far as the Petitioners are concerned and the order of cognizance dated 13.7.2007 passed by the Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in Complaint case No.296 of 2007 is hereby set aside.
