The petitioner apprehends his arrest in connection with Parihar P.S. Case No. 115 of 2016 registered for the offence(s) punishable under section(s) 147, 149, 341, 342, 504, 286 and 353 of the Indian Penal Code.

On perusal of the record it appears that the prayer for anticipatory bail of the petitioner was allowed by the learned Sessions Judge, Sitamarhi on 24.08.2016 in A.B.P. No. 1616 of 2016 wherein the petitioner was directed to be released on bail in the event of arrest or surrender within a period of four weeks from the date of order on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.38191 of 2017 (2) dt.17-08-2017 2/2 satisfaction of the Court below. After one year of said order, the petitioner again filed A.B.P. No. 692 of 2017 before the Sessions Judge, Sitamarhi and his prayer after hearing, was rejected on 5.7.2017.

In the facts and circumstances of the case, I do not find any merit in this criminal miscellaneous application and the same is, accordingly, dismissed. If the petitioner surrenders before the Court below and satisfies the Court for not surrendering before the Court as per the direction of the Sessions Judge, the same shall be considered on merit without being prejudiced by the order of this Court.
