JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-08-2019 The petitioner seeks quashing of the order dated 11.08.2017 passed by the learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 239 of 2017 whereby cognizance has been taken under Sections 417, 418, 419 and 420 of the Indian Penal Code.

Mr. Sudish Kumar, learned advocate for the petitioner, after some arguments, seeks permission to withdraw this petition in order to enable the petitioner to approach the court below, if so advised, at the

Patna High Court CR. MISC. No.43061 of 2019(2) dt.05-08-2019 2/2 appropriate stage of discharge.

Should such an application be filed by the petitioner, the same shall be disposed of by the court below by a reasoned order without being prejudiced by the fact that the present petition has not been entertained.
