ANJANA MISHRA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Birpur (Bhim Nagar) P.S. Case No. 74 of 2016 registered under Sections 379, 363, 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that admittedly it is a case where boy and girl have eloped. It is further submitted that victim girl in her statement under Section 164 of the Cr. P.C has categorically stated that she has gone along with the petitioner out of her own sweet-will and they have reported it to their respective parents. It is, however, submitted that the girl got medically examined and her age was assessed to be 17-18 years and there was no sign of rape or sign of any physical assault on her body as per medical report. It is further submitted that the petitioner is a student and has no criminal antecedent.

Patna High Court Cr.Misc. No.27604 of 2016 (2) dt.18-07-2016 Considering the facts and circumstances of the case, the above named petitioner in the event of his arrest/surrender within a period of four weeks from the date of copy of receipt of the order, shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, District-Supaul, in connection with Birpur (Bhim Nagar) P.S. Case No. 74 of 2016 (G.R. No. 266 of 2016), subject to condition as laid down under Section 438 (2) of Cr.P.C. (Anjana Mishra, J) m.p.
