In this case, the petitioner is seeking anticipatory bail in connection with Karja P.S. Case No. 146 of 2012 registered for offence under sections 467, 468, 471 and 420/34 of the Indian Penal Code.

Allegation has been made against the petitioner to have misappropriated the fund of MANREGA.

The Police investigated the matter, but no charge sheet has been submitted as yet.

Considering the aforesaid facts and circumstance of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner, above named, be

Patna High Court Cr.Misc. No.28478 of 2016 (2) dt.25-07-2016 2/2 released on bail on executing bail bond of Rs.15,000/-with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Tiwary, Judicial Magistrate 1st class, West Muzaffarpur in connection with Karja P.S. Case No. 146 of 2012, subject to the condition as laid down under Section 438 (2) Cr. P.C. and also subject to his fully co-operating with the Investigating Agency. If the Investigating Officer finds that he is not fully co-operating with the investigation, he would be at liberty to approach the trial court for cancellation of his bail. This bail shall be limited up to the stage of filing of the charge-sheet. In case, he is charge-sheeted by Police, he has to surrender in the court below and pray for regular bail.
