2. The Superintendent of Police, Aurangabad along with the Investigating Officer of the case in compliance of the order dated 22.08.2024 are present in the Court.

3. The Superintendent of Police, Aurangabad at the outset submits that a mistake has been committed in not giving the benefit of Section 41(A) of the Cr.P.C. to the petitioner, but then submits petitioner has not been arrested.

4. It is also submitted that the mistake occurred inadvertently and was not deliberate. It is next submitted that notice under Section 41(A) of the Cr.P.C. shall be issued to the petitioner, on which the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the anticipatory bail

5. Permission is accorded.

6. Accordingly, the anticipatory bail application is dismissed as withdrawn.

7. The personal appearance of the Superintendent of Police, Aurangabad and the Investigating Officer of the case is dispensed with.
