====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-09-2021 Heard Mr. Vinod Kumar, learned counsel for the petitioner and Dr. Indiwar Kumari, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Gaya Rail P.S. Case No. 45 of 2020 registered for the offences punishable under Sections 08/20, (b) II (c) of NDPS Act.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 25.11.2020 passed in Cr. Misc. 28615 of 2020 with liberty to renew his prayer for grant of regular bail after nine months if the trial does not show any progress.

No.52017 of 2021(2) dt.22-09-2021 2/3 The allegation, as per the First Information Report, is that total quantity of 13.250 Kilograms Ganja has been recovered from the possession of petitioner. Learned counsel for the petitioner submits that while rejecting the bail application of the petitioner earlier, this Court had given liberty to the petitioner, to renew his prayer for bail after nine months and referring to Annexure3 series learned counsel submits that there is no progress in the trial. Learned counsel next submits that the charges have been framed against the petitioner and he is in custody since 28.2.2020 having no criminal antecedent.

Regard being had to the submission made by the parties and taking into consideration the materials on record, the fact that less than commercial quantity of Ganja has been recovered and the petitioner is in custody since 28.2.2020 having no criminal antecedent and this is second attempt on behalf of the petitioner for grant of regular bail, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
