Heard learned counsel for petitioners, learned counsel for the informant as well as learned counsel for the State. Petitioners, who are in custody, seek bail in connection with Jokihat P.S. Case No. 40 of 2018 registered for the offences punishable under Sections 448, 341, 323, 324, 307, 379, 354(B), 427, 504 and 34 of the Indian Penal Code. Informant alleged that when he was keeping his hen in chicken coop petitioners along with other co-accused came there and started abusing him and on protest assaulted him and his family members and thereafter torn the clothes of his

It has been submitted on behalf of the petitioners that they are innocent and has committed no offence. They have falsely implicated in this case due to enmity. Injury is simple in nature. They have no criminal antecedent. He is in custody since 03.04.2018.
Learned counsel for the informant has vehemently opposes the grant of bail.
Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 40 of 2018.
