"That in the larger public interest this is an application for issuance of an appropriate writ, order or direction directing the Respondents to cancel the decision of closing the Bijwanpur Railway Crossing of Pawapuri Road, Railway Station in the Dist.

Of Nalanda, Bihar till providing an alternative arrangement i.e. under pass or overbridge and further direct the Respondents to provide underpass or overbridge as closing of Railway

Patna High Court CWJC No.9924 of 2025 dt.13-10-2025 2/3 Crossing is going to affect 25,000 to 50,000 people of the locality.

And further respondents be restrained from closing the Railway Crossing Pawapuri Road, Railway Bijwanpar.

And for any other relief for which the petitioner is entitled in the facts and circumstances of the case."

2. Petitioner has approached the concerned authorities by submitting representations on 04.04.2025 and 05.05.2025. There is inaction on the part of the concerned respondent. In the counter affidavit in para-8 it is stated as under: "8. That on receiving demand from local public and their representative for alternative arrangement, the matter was discussed between the Railway Authorities and NHAI Authorities. Thereafter, NHAI agreed to provide alternative arrangement at the location where L.C. Gate has been eliminated. As a result of said discussion, a Joint Inspection of Railway and NHAI authorities has been conducted to construct a Limited Height Sub-way (LHS) near Pawapuri yard."

3. Perusal of the aforementioned pleading in para-8 one cannot draw inference what are the date and events.

4. Be that as it may, the concerned authorities are hereby directed to pass a suitable order on the petitioner's representation within a period of four weeks from today.

5. With the above observations present petition stands disposed of. The concerned authority is hereby directed to communicate the decision to the petitioner.
