Patna High Court CWJC No.12239 of 2019 dt.26-06-2019 2/3 The petitioner is aggrieved by the order dated 06.03.2019 passed by the District Programme Officer, Banka, whereby the claim of the petitioner has been rejected.

2. The petitioner has an avenue of appeal against the aforesaid order dated 06.03.2019 before the District Magistrate, Banka, which has not been exhausted by him.

3. After some arguments, the learned counsel for the petitioner seeks permission to withdraw this petition in order to agitate against the order impugned dated 06.03.2019 before the District Magistrate, Banka.

4. Should such an appeal be filed by the petitioner before the District Magistrate, Banka within a period of two weeks from today, the same shall be disposed off within a further period of four weeks thereafter.

5. Needless to state that any order which would be passed by the District Magistrate, Banka would be a reasoned order in accordance with law and after affording proper opportunity to the parties, viz., the petitioner, private respondent, if any, and other stake holders.

6. With the aforesaid observation/direction the petition is permitted to be withdrawn.
